MEDAN | INDATANEWS.COM ~ Indonesia's Acting Deputy Attorney General, Prof. Dr. Asep N. Mulyana, SH., M.Hum, has reaffirmed his support for the introduction of the Deferred Prosecution Agreement (DPA) into Indonesia's national legal framework. The statement was delivered during the 72nd Dies Natalis celebration of the Faculty of Law, Universitas Sumatera Utara (USU), held at the USU court building in Medan.
He was accompanied by the Head of the North Sumatra Prosecutor's Office, Dr. Harli Siregar, SH., M.Hum, alongside senior judicial officials, academics, and members of the USU academic community.
Scientific Address on Criminal Law Transformation
In his scientific presentation titled "Transformation of National Criminal Law Following the Implementation of the New Criminal Code (KUHP) and Criminal Procedure Code (KUHAP)," Prof. Asep emphasized the need for a modern criminal justice system that prioritizes prevention and the protection of state assets.
He stressed that ongoing legal reforms must be directed toward efficiency, fairness, and sustainable crime prevention, ensuring that the justice system remains responsive to societal developments.
Understanding the Deferred Prosecution Agreement (DPA)
Prof. Dr. Asep explained that the Deferred Prosecution Agreement is a legal mechanism allowing the temporary suspension or termination of criminal prosecution, provided that certain conditions are met.
These conditions typically include compensation for damages, full cooperation with law enforcement authorities, and the implementation of corporate compliance systems. If these obligations are fulfilled, the prosecution may be permanently discontinued.
He noted that the DPA represents a modern legal instrument that balances efficiency in criminal justice with restorative justice principles, accountability, and prevention.

He further emphasized that the implementation of DPA must be integrated into a broader national criminal law reform agenda. Transparency, accountability, and a restorative, corrective, and rehabilitative approach were highlighted as essential principles.
The ultimate goal of legal development, he added, is to strengthen a fair, legally certain, and human rights-based justice system.

The event was attended by several prominent figures, including Deputy Chief Justice for Non-Judicial Affairs of the Supreme Court of Indonesia, Dr. Dwiarso Budi Santiarto, SH., M.Hum, Chief Judge of the Medan High Court, Dr. H. Siswandriyono, SH., M.Hum, and USU Rector Prof. Dr. Muryanto Amin, S.Sos, M.Si.
Representatives from the police, the Military Command I/Bukit Barisan, the Prosecutor's Office, and law students also participated in the event.
